Terms of Service

These Terms of Service ("Terms") govern access to and use of the OnShift HQ website and application. By creating an account or using OnShift HQ, the company and its users agree to these Terms.
Accounts and eligibility
OnShift HQ is intended for businesses and their employees. The person who creates a company account confirms they are authorized to act for that company. Each user is responsible for keeping login credentials confidential and for activity that occurs under their account.
Trials, subscriptions, and billing
New companies may start a free trial of the length shown on the Pricing page. A trial converts to a paid subscription only when the company selects a plan inside the app. Subscription fees, billing cadence, included employee allowances, and any per-employee overage are shown on the Pricing page and in the app at the time of purchase. Fees exclude applicable taxes unless stated otherwise.
Subscriptions renew automatically at the end of each billing period until cancelled. A company can cancel from inside the app; access continues until the end of the current paid period. Except where required by law, fees already paid are not refunded.
Customer responsibilities
The company is responsible for the accuracy of the information it enters, for configuring settings such as geofencing, attendance thresholds, visibility, and notifications in line with its own policies and applicable law, and for informing its employees about how it uses OnShift HQ, including any location context recorded at punch events.
OnShift HQ estimates labor cost from tracked time and the pay assumptions the company enters. These figures are estimates for operational visibility only. OnShift HQ is not a payroll system and does not calculate wages owed, taxes, deductions, or benefits.
Acceptable use
Users may not misuse OnShift HQ, including by attempting to access data or features beyond their permissions, uploading unlawful or harmful content, interfering with the service, or using the service to harass or discriminate against others. We may suspend or terminate accounts that violate these Terms.
Customer content and intellectual property
The company owns the content it and its users add to OnShift HQ. The company grants OnShift HQ a limited license to host, process, and display that content solely to provide the service. OnShift HQ and its software, design, and trademarks remain the property of OnShift HQ.
Service availability and changes
We work to keep OnShift HQ available and reliable, but the service may be interrupted for maintenance, updates, or events outside our control. We may add, change, or remove features over time. Where a change materially reduces core functionality, we will provide reasonable notice.
Disclaimers and limitation of liability
OnShift HQ is provided "as is" and "as available" without warranties of any kind, express or implied, to the fullest extent permitted by law. To the maximum extent permitted by law, OnShift HQ will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, and our total liability for any claim will not exceed the fees paid by the company in the twelve months before the claim.
Termination
A company may stop using OnShift HQ at any time by cancelling inside the app. We may suspend or terminate access for violation of these Terms or non-payment. After termination, company data is handled as described in the Privacy Policy.
Governing law and disputes
These Terms are governed by the laws of the jurisdiction in which OnShift HQ is organized, without regard to conflict-of-law rules. Disputes will be resolved in the courts of that jurisdiction unless applicable law requires otherwise.
Changes to these Terms
We may update these Terms from time to time. The effective date at the top of this page shows when they were last changed. Continued use of OnShift HQ after changes take effect means acceptance of the updated Terms.
